Terms of Service
Welcome to Sol & Skara. These Terms of Service ("Terms") govern your access to and use of solandskara.com (the "Site") and any purchase you make from it. The Site is operated by Paul Schütte Ecom, a sole proprietorship (Einzelunternehmen) of Paul Schütte, trading as Sol & Skara, Wildenbruchstraße 44, 60431 Frankfurt am Main, Germany (VAT ID: DE370290434) ("we", "us", "our"). By accessing the Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
To place an order you must be at least 18 years old, or the age of majority in your place of residence, and able to enter into a legally binding contract. By placing an order you confirm that you meet these requirements and that the information you provide is accurate and complete.
2. Products and Availability
We sell lighting and home décor products. We make every effort to display our products, their colours, and their details as accurately as possible. However, actual colours and finishes may vary slightly depending on your screen settings, and product images are for illustration. All products are subject to availability, and we may limit quantities, discontinue any product, or change our range at any time without liability to you.
3. Pricing
All prices are displayed in Australian Dollars (AUD) and are final, with no additional taxes or import duties charged to you on delivery (see our Shipping Policy). While we make every effort to ensure prices are accurate, errors may occasionally occur. If we discover an error in the price of an item you have ordered, we will contact you as soon as possible and give you the option to confirm your order at the correct price or cancel it. If we are unable to reach you, we may treat the order as cancelled and refund any amount already paid.
4. Orders and Acceptance
When you place an order, you are making an offer to purchase. You will receive an order confirmation email acknowledging that we have received your order — this acknowledgement does not constitute acceptance. A binding contract is formed only when we dispatch the item(s) to you. We reserve the right to refuse or cancel any order before dispatch, including if the item is unavailable, if there was an error in pricing or product information, or if we reasonably suspect fraudulent or unauthorised activity. If we cancel an order for which you have already paid, we will issue a full refund.
5. Payment
Payment is collected in full at the time of purchase through our secure checkout, which is processed by trusted third-party payment providers (including Shopify Payments and PayPal). Your selected payment method is charged once per order — we do not offer subscriptions and do not store, schedule, or apply any recurring charges. There are no hidden fees beyond the total shown at checkout. We do not receive or store your full card details; these are handled by our PCI-DSS compliant payment providers. If a payment is declined or fails, your order will not be completed.
6. Shipping and Delivery
We ship exclusively within Australia. Shipping is free on every order. All delivery times stated on the Site are estimates and are not guaranteed. Risk of loss and title for items pass to you upon delivery to the carrier. Full details of processing times, transit times, customs handling, delivery attempts, and lost or damaged parcels are set out in our Shipping Policy, which forms part of these Terms.
7. Returns, Refunds and Cancellations
We want you to be satisfied with your purchase. Your rights to return items, obtain refunds, request exchanges, and cancel orders, together with the applicable timeframes and process, are set out in full in our Refund Policy, which forms part of these Terms. These rights are in addition to any rights you have under applicable consumer law.
8. Your Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you are entitled to under the Australian Consumer Law or any other mandatory law of your country of residence that cannot lawfully be excluded. Where our goods come with guarantees that cannot be excluded under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
9. Acceptable Use
You agree to use the Site lawfully and not to misuse it — for example, by attempting to gain unauthorised access, introducing malicious code, scraping content, infringing our intellectual property, or interfering with the Site's operation or security. We may suspend or terminate your access if you breach these Terms.
10. Intellectual Property
All content on the Site — including text, graphics, logos, images, and product descriptions — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or use this content without our prior written permission. Sol & Skara is an independent online retailer and sources products from third-party suppliers. All third-party trademarks and product names remain the property of their respective owners and are used for descriptive purposes only.
11. Accuracy of Information
We strive to keep the information on the Site current and accurate, but we do not warrant that all content is complete, error-free, or up to date. Content is provided for general information and may be changed or updated at any time without notice.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Site or our products. Our total liability arising out of any order shall not exceed the amount you paid for that order. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law, including your rights under Section 8 above.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The updated version will be posted on this page with a revised effective date and applies to all orders placed after it is posted.
15. Governing Law
These Terms and any dispute arising from them are governed by the laws of Germany. This choice of law does not deprive you of the protection afforded to you by the mandatory consumer protection laws of your country of residence, including, for customers in Australia, the Australian Consumer Law. Disputes may be brought before the competent courts, without prejudice to any mandatory right you have to bring proceedings in the courts of your place of residence.
